1. Acceptance of Terms

By accessing and using the Asian Gourmet website (asiangourmetfood.com), you accept and agree to be bound by the terms and provision of this agreement. Asian Gourmet is a restaurant brand operated by Regas Enterprises, located in Brevard County, Florida, in Melbourne. If you do not agree to abide by the above, please do not use this service. Asian Gourmet reserves the right to update these terms at any time without prior notice.

2. Restaurant Services

Asian Gourmet offers the following services:

• Dine-In Service: Dining at our Melbourne, FL location during operating hours
• Takeout Service: Food prepared for pickup at our Melbourne location
• Online Ordering: Ordering through SpotON platform for takeout and delivery
• Reservations: Table reservations for dine-in service

Availability of services may vary by location. All services are subject to our current operating hours and menu availability.

3. Reservation Policy

Making a Reservation

Reservations for dine-in service can be made through our website, by phone at (321) 345-5635, or in person. We request at least 48 hours advance notice for all reservations.

Confirmation

Upon making a reservation, you will receive a confirmation. If you opt in to SMS communications, you will receive a text message confirmation and a reminder 24 hours before your reservation time.

Cancellation

If you need to cancel a reservation, please do so at least 48 hours in advance. Cancellations made with less than 48 hours notice may result in a loss of your reservation slot during peak hours.

No-Show Policy

A no-show is when a party does not arrive or cancel their reservation within 30 minutes of the reserved time. Frequent no-shows may result in being asked to provide a credit card for future reservations or dining restrictions.

Party Size Changes

If your party size changes significantly from your reservation, please notify us as soon as possible so we can accommodate you appropriately.

4. Online Ordering

Online orders are processed through SpotON, a third-party payment and ordering platform. By placing an order through SpotON, you agree to SpotON's terms of service and privacy policy.

Pricing and Availability

All prices are in U.S. dollars and subject to change. Availability of menu items is subject to our current inventory. We reserve the right to substitute items with similar menu items if an item becomes unavailable.

Order Confirmation

Once an order is placed, you will receive a confirmation. If you have opted in to SMS communications, you may receive updates about your order status via text message.

Delivery and Pickup

Estimated delivery and pickup times are provided for reference but are not guaranteed. Delays may occur due to high order volume, traffic conditions, or other unforeseen circumstances.

5. SMS/Text Message Communications

Asian Gourmet uses SMS (text message) technology to enhance your experience with reservation confirmations, reminders, and promotional offers.

Types of Messages

• Transactional Messages: Reservation confirmations, order updates, appointment reminders, and service alerts. These messages are sent as needed regardless of your preference settings.
• Promotional Messages: Special offers, menu updates, and marketing communications. These are sent only if you have explicitly opted in.
• Reminder Messages: 24-hour reminders for your upcoming reservations (transactional).
• Waitlist Notifications: When your table or order is ready (transactional).

Opt-In Information

Opting in to SMS communications is voluntary and not required to receive our restaurant services. You may opt in by:

• Providing your mobile phone number during reservations
• Providing your mobile phone number during online orders
• Texting a keyword to our SMS number
• Checking the SMS opt-in box on our website

By opting in, you consent to receive SMS messages from Asian Gourmet sent via Twilio, our SMS service provider.

Message Frequency

• Transactional Messages: Sent as needed (no limit). These may include reservation confirmations, reminders, and order status updates.
• Promotional Messages: Opt-in subscribers may receive up to 4 promotional messages per month on average.

Standard Message and Data Rates Apply

Message and data rates from your wireless carrier will apply to all SMS messages sent to and received from Asian Gourmet. This includes any automated SMS messages. Check your wireless service plan for details about included text messages and data allowances.

How to Opt Out

To stop receiving SMS messages from Asian Gourmet at any time:

• Reply STOP or UNSUBSCRIBE to any text message from us
• Update your preferences through your account on our website

We will honor your opt-out request immediately. However, transactional messages (confirmations, reminders) may continue to be sent if you have an active reservation or order.

Supported Carriers

SMS messages are delivered via the following major U.S. wireless carriers: AT&T, Verizon, T-Mobile, Sprint, Boost Mobile, Cricket Wireless, MetroPCS, U.S. Cellular, and Virgin Mobile. Message delivery may vary by carrier and location.

Message Delivery

While we strive to deliver all messages promptly, messages may be delayed, blocked, or not delivered due to factors beyond our control, including:

• Wireless carrier delays or blocks
• Network issues
• Phone carrier filtering or spam blocks
• Incorrect or outdated phone numbers
• Inactive or suspended mobile accounts

Asian Gourmet is not responsible for delays or failures in message delivery.

Device Compatibility

SMS messages are compatible with any SMS-capable mobile device. If your device does not support SMS, we recommend adding your contact information to a different SMS-capable phone or opting out of SMS communications.

6. Intellectual Property

All content on the Asian Gourmet website, including but not limited to text, graphics, logos, images, and software, is the property of Asian Gourmet or its content suppliers and is protected by international copyright laws. You may not reproduce, modify, distribute, or transmit any content without our express written permission.

7. Limitation of Liability

Asian Gourmet and its owners, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the website, services, or products, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our liability to you for any reason is limited to the amount paid by you for services or products.

8. Allergen Disclaimer

Asian Gourmet prepares food in kitchens that may contain allergens. While we take precautions to prevent cross-contamination, we cannot guarantee that our food is completely free from allergens including but not limited to: peanuts, tree nuts, sesame, soy, shellfish, fish, milk, eggs, and other common allergens.

Please inform our staff of any allergies before placing an order or during your reservation. Detailed ingredient information is available upon request. Customers with severe allergies assume all responsibility for food choices and consumption.

9. Age Requirement for Promotional Communications

You must be at least 21 years of age to opt in to receive promotional SMS messages from Asian Gourmet. By providing your phone number and opting in to promotional communications, you represent and warrant that you are at least 21 years of age.

10. Changes to Terms

Asian Gourmet reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the website. Your continued use of the website and services following the posting of revised Terms means you accept and agree to the changes.
